Description | 1. James Lloyd of the Inner Temple, esq., guardian of Mary Holland and Elizabeth Holland, infant daughters and co heirs of David Holland, deceased, son and heir of Piers Holland of Vaerdrye, co. Denbigh, esq., deceased, Dorothy Holland, widow, late wife of the said David Holland and mother of the said wards, and Mary Lloyd, spinster, sister of the said Dorothy.
2. William Price of Rhiwlas, co. Merioneth, esq.
Articles of agreement made beforte the marriage of William Price and Mary Holland. Considerations: (1) The settlement of the capital messuages of Vaerdrye and Kinmell and lands in Botegwall, Bodoryn, Kegidog, Abergele, Llaethvaen, Trovarth and Gwrych, together with all the ancient estate of David Holland and Piers Holland now descended to the grandchildren of Piers Holland (Mary and Elizabeth); also lands purchased by David Holland which never belonged to Piers Holland but were settled by David Holland the greatgrandfather upon David Holland, his grandchild, husband of the said Dorothy Holland, and father of Mary and Elizabeth.
(2) The freeing of the lands aforementioned from all debts and incumbrances etc., with the exception of the following debts and charges:
(a) £2500 borrowed by Dorothy Holland for the purpose of freeing the ancient estate from all extents.
(b) Annuity of £120 payable to Piers Holland for his life and the portion (£800 to be paid at the rate of £200 p.a. after the death of Piers Holland) of Dorothy Holland daughter of Piers Holland.
(c) Annuity of £60 payable to Ralph Holland. If Ralph dies before his father, then Dorothy, his sister is to have an extra £100 added to her portion excepting the King's rent and farm rent (£20 p.a.) and the interest of Elizabeth Hollland, second daughter of the said Piers, to the ancient estate which amounts to £400 p.a. whereof she is to have a moiety chargeable with one half of the incumberances which may be legally imposed on the said Elizabeth's share. The said James Lloyd, Dorothy Holland and Mary Lloyd undertake to save harmless the said William Price and Mary from the said Elizabeth's interest in the mill called Myvod Mill (£30 p.a.)
(d) Wardship rent of £3 p.a. and the annuity of Dorothy Holland (£100 p.a.) for the maintenance of herself and her daughter Elizabeth until the latter be married or comes of age. After which event the said William Price and Mary shall only be liable for the payment of £50 p.a. during the lifetime of the said Dorothy, and as for the other £50, the said Dorothy is left at liberty to deal with her daughter Elizabeth as she thinks fit.
Agreements:
(1) the marriage to take place at or before Michaelmas next.
(2) James Lloyd etc. to settle the said lands and estates on William Price and Mary with the following limitations:
(a) the moiety of the capital messuages and lands (except Myvod Mill) belong of right to the said Mary, being the purchase of the said Dorothy Holland, her mother, and those lands called purchased lands left by the will of David Holland, late husband of the said Dorothy, to the said Dorothy. These premises she, the said Dorothy, now covenants to convey to William Price and Mary and also to warrant them from the said Elizabeth's claim and to procure the said Elizabeth's release thereof to William Price and Mary when she comes of age.
(b) Myvod Mill to the use of William Price and Mary for ever.
(c) Ancient estate - to the use of William and Mary until the former shall be reinbursed of such sums of money as are provided for in the deed.
(d) Purchased lands - if Mary Holland dies without issue before she is 21 or that she has neither sold nor settled the inheritance of these lands on William Price, then the lands are to be to the use of Dorothy Holland for her life with remainder to her right heirs.
(3) James Lloyd to assign to William Price his interest in the wardships of Mary and Elizabeth granted to him by the Court of Wards and Liveries, 15 Oct. 1636.
(4) James Lloyd, Dorothy Holland and Mary Holland to grant a lease to William Price for 7 years renewable of the premises (except the mill and purchased lands) during the term of 60 years specified in the lease thereof granted by Piers Holland to Sir Edward Lloyd, James Lloyd, John Lloyd and Dorothy Holland, and as authorised in another lease of the premises granted 4 Oct. 1633.
(5) If Mary Holland should die without issue by W.P. before she is 21, then W.P. is only to have the benefit of the 60 years lease, the wardship of Elizabeth Holland and the inheritance of Myvod Mill in place of Mary Holland's portion, the debts etc. being paid out of the ancient estate.
(6) If Elizabeth Holland dies unmarried or does not dispose of her right in the moiety of the ancient estate, by reason whereof the said moiety shall come to W.P. and Mary, then the said Dorothy Holland shall have a further £60 in addition to the annuity of £100 out of the rents and profits of the said moiety.
(7) James Lloyd, D.H. and M.Ll. agree on behalf of Elizabeth Holland that she will surrender the purchased lands to W.P. and mary when she comes of age and that she shall in the meantime settle and convey the said lands.
