Consideration, £650.
Recites that the premises were part of lands mortgaged by John Owen of Presaddfed to Catherine, Marchionese of Caernarvon in 1745 for £7350, and subsequently unredeemend by him. The mortgage security then came to the Marchioness's daughters, Lady Catherine Stanhope and Lady Jane Bridges amongst the other lands and possessions of their mother. Lady Jane received as her share property including the John Owen security and prior to her marriage in 1754 conveyed the same in trust to Edwyn Francis Stanhope and William Hughes of the Inner Temple who were empowered to call in all moneys due on the security. John Owen died in 1754 and his brother Robert Owen of Ty Newydd, Llansilin, suucceeded him as heir and became entitled to the equity of redemtion of the mortgaged premises. R.O. however was unable to redeem the mortgage himself, but got William Jones of Plas Gwyn to advance the money ( a total of £8070). The security was then transferred to William Jones, who died in 1755 leaving Jane Panton, his daughter as executrix. Tn 1758 Robert Owen conveyed Presaddfed and Ty Newydd and other lands of his to Thomas Kyffin senior in trust so that he with the consent of Emma Roberts might sell the land in parcels to discharge the debts of John Owen. Robert Owen died 12 October 1758 and Thomas Kyffin the same month and year. All the estates of the said John Owen and Robert Owen were then put up for sale by Thomas Kyffin and Emma Roberts 18 August 1764. Hugh Hughes agreed with Thomas and Emma to purchase Lot 37 (being the lands called Botteniel etc.) and it was also agreed that the purchase price of £650 should be paid to Paul Panton and Jane as a consideration for releasing their right and interest in the said Lot which was comprised in the lands mortgaged by John Owen to the Marchioness and afterwards released to William Jones of Plas Gwyn. |
